XPO Logistics Trucking Subsidiaries Sued Over Driver Classification

Class-action lawsuit argues that drivers were misclassified as independent contractors

The lawsuit seeking class action status, filed in Los Angeles Superior Court, argues that drivers for XPO subsidiaries Pacer Cartage Inc., Harbor Rail Transport and PDS Transportation Inc. failed to pay minimum wage, provide meal breaks and rest breaks and to reimburse business expenses, among other allegations.
In an emailed statement, XPO Chief Operating Officer Troy Cooper said: “We believe this case is without merit and plan to litigate it vigorously. We are in constant dialogue with our independent-contractor carriers and believe the vast majority of them value the significant benefits that operating independently can bring.”
XPO, a transportation services company, has grown rapidly over the past few years through acquisitions. Until last year, when XPO purchased trucking company Con-way Inc. and French transportation firm Norbert Dentressangle SA, most of the company’s subsidiaries were “asset-light,” meaning their contractors owned the equipment—for example, trucks—that they used to transport cargo.
The trucking companies that were sued Monday perform what is known as drayage trucking services, or hauling goods the short distance between seaports and nearby rail yards and warehouses, a key link in the national supply chain. Within the domestic drayage market, estimated by research firm FTR Transportation Intelligence as generating $12 billion in annual revenue, the independent owner-operator model is common.
But that model has increasingly come under legal scrutiny, in drayage as well as other sectors of the transportation industry. Alleged misclassification of workers has led to high-profile lawsuits against Uber Technologies Inc. and FedEx Corp., among others. FedEx settled a case in California last year for $228 million. Last month, a California judge ruled to expand a class-action suit brought against Uber by three drivers who claim they are employees, not contractors, and deserve benefits such as workers’ compensation.
Workers in the lawsuit filed Monday are being represented by the Los Angeles law firm Kabateck Brown Kellner LLP, which has previously brought similar claims against several drayage trucking companies, including Pacer. A $4.25 million settlement with Pacer, which they reached last May, is awaiting a judge’s approval.

  7. It would be nice to see a united front but I doubt either company has the balls to do it. It would take 100% of the centers that have not filed to have had ULP's filed in order to get NLRB approval like Gardena did. Now of course you could try to organize a national "sick out" day but that still would not get a total participation. Look around each of your centers and you will find 40-50% support at the most.

    United is the only way and sadly we can not reach the majority let along everyone at each terminal. Slowly over time we will gain strength but people need to stop being scared. We have named 2016 as "The Year We Speak Up" at FedEx Freight, we suggest you do the same at XPO. The 1% don't care or listen to the bottom 1%. Let 70% or 80% speak up and the 1% will take notice.

  11. ATLANTA — Less than three months after acquiring Con-way, XPO Logistics plans a significant reduction in purchased transportation costs in its less-than-truckload business.

    “We handle about two-thirds of LTL linehaul with our own trucks,” Bradley S. Jacobs, XPO chairman and CEO, said at the SMC3 JumpStart 2016 conference here Jan. 18.

    The other third of that former Con-way Freight linehaul business handled by contracted carriers will be put up for bid in the first quarter for the first time since 2009, Jacobs said.

    That’s an example of the type of savings opportunities XPO is looking for as it integrates Con-way and the former Norbert Dentressangle into its overarching logistics business.

    XPO said in November it expects to save more than $30 million a year by integrating the trucking and logistics operations of $5.8 billion Con-way with its own portfolio of services.

    The plan is to add $170 million to $210 million to Con-way’s operating profit in two years. An unsteady economy, however, is unsettling shippers and may be accelerating those plans.

    “There’s pressure from the C-suite on transportation people to cut costs,” Jacobs told the SMC3 conference. “We’re sensitive to that. We have to make sure our cost structure is very lean.”

    Con-way Freight was working to reduce purchased transportation costs and optimize linehaul before the Oct. 30 acquisition, but the amount of money at stake is believed to be significant.

    In the six months that ended June 30, Con-way Freight’s purchased transportation costs were $262.5 million, a 10 percent drop from the first half of 2014, partly thanks to lower fuel costs.

    Jacobs is looking for ways to make XPO more efficient across its businesses in a year he already has said would be dedicated to absorbing nearly $7 billion in 2015 acquisitions.

    “In every single category, we’re asking now that we’re a $15 billion company spending almost $14 billion on things, are we spending the right amount of money?” Jacobs said.

    XPO is trying to make its less profitable LTL accounts more profitable, but with the economy growing more slowly, this is not “the best time” to ask customers for big rate hikes, Jacobs said.

    “When all's said and done, shippers want to take cost out,” he said. “With the economy getting more iffy, the focus on on costs becomes even more important” to shippers and carriers.

  30. I am from Milwaukee XML and I heard about this site. We just started our new bids and I'm on the dock more now getting less hours. We are getting write ups for motor moves despite dropped freight levels. I barely get 40 hours a week and when I asked management, they say they can't do anything until levels pick up. I overheard today we will be hiring more part time dock workers. Whe are we hiring more help when we can't even get full hours now and get bitched at for our production? Which brings me here, if we had a union in place, would alot of this stop? I would rather work more when it gets busy than hire more part time help and get 35 hours a week and not drive. Nobody likes what is happening here, management is all over everyone whether it's dwell times, motor moves, overtime, it's more heads down than last year. New employees are quitting even under theur driver school contact.

  32. So here is what's going on the logistics sector. Mind you people we're always compaired to FedEx..and analyst C troubled times for FedEx due to Amazon. Can anyone guess what kind of effect Amazon will have on us????

    The long-term thesis on FedEx (FDX +3.4%) and UPS (UPS +2%) may be slightly altered after Amazon reclassified itself in its latest SEC filing (tipped by Baird).
    For the first time, Amazon officially described itself as a "Transportation Services Provider."
    Amazon's logistics capabilities build-out is seen as slowly becoming a larger consideration for the shippers.

    XPO Logistics (NYSE:XPO) says it is cutting ~190 jobs to address redundancies resulting from its acquisition of the Con-way trucking business last October.
    XPO expects the reductions, mostly in administrative and back office positions, to cut costs by more than $20M/year and boost perating profit by $170M-$210M over two years.
    XPO says it has realized ~$50M in annualized savings in the three months since it acquired Con-way.

We have the same problem in Miami our FOM the only thing he worries about is how he likes to stick it to you when you do something wrong instead of helping you out or work with you to solve the issue or problem, no Mr FOM will tell that's not my Problem, right your to Busy worrying about how to Implement Discipline on all of us for trying to do the our job the best we can, but here's the real Problem Mr Jacobs your Management is one of the Reasons we went UNION! mind you Mr Jacobs noone wanted the Union but the Favoritism and Discrimination from your Management team of XConway including Supervisors with there Favorites Selected Personal they know who they are sad part about it is that it's not really the workers fault it's Management or in this case the Supervisors that handles their Shifts so if you need to Blame anyone Blame your Management Staff. THIS IS ONE OF THE REASONS WHY WE WENT UNION. So until you can fix your Management personal the Conflicts Favoritism, Discrimination and certain personal Privileges that keep occuring IN NMF/MIA SIR, THE GAMES WILL BE OR REMAIN THE SAME so you can really see it really wasn't the Employee's FAULT we rest our case.

    SAN FRANCISCO — After making moves into trucking and air freight, Amazon appears to be turning its thoughts to the sea.

    The e-commerce company's Chinese affiliate, Amazon China, has registered with the U.S. Federal Maritime Commission to become a licensed ocean freight forwarder.

    The filing was spotted Wednesday by Flexport, a San Francisco-based freight forwarder for consumer product makers.

    The filing is just the first part of a longer regulatory journey required before Amazon China could actually ship packages. But it's a tantalizing piece of the puzzle as the Seattle company appears to be building out its own delivery service.

    In the last two years Amazon has moved into leasing its own trailers and cargo jets, both in the United States and Europe. This appears to be the company's first move into ocean shipping, said Jarrett Streebin, CEO of EasyPost, a shipping and tracking platform for high volume e-commerce companies.

    Amazon quietly builds its own shipping company

    The license would allow Amazon China to provide ocean freight delivery to other companies and could mean that Amazon is moving into the $350 billion ocean freight market.

    “This means they can provide ocean freight services for other companies. Looks like they are indeed moving quickly into the transportation business,” said John Haber, CEO of Spend Management Experts, a supply chain management consulting firm

    The license is for non-asset owners, meaning Amazon doesn’t plan to actually purchase and own ships. Instead, it would allow the company to offer international shipping.

    The filing is for Amazon China, formerly the Chinese e-commerce shopping site Joyo.com, which Amazon purchased in 2004. That could mean the company plans to ship goods from China outward.

    That makes a lot of sense, said Ryan Petersen, CEO of Flexport, who first noticed the filing on Wednesday.

    It would allow Chinese factories to sell directly to U.S. customers through Amazon.

    “They won’t need the middle man,” he said.

    The loser in all this will be Amazon resellers who buy from China and sell to customers in the United States. “They’re going to be disrupted,” Peterson said.

    He doesn’t expect U.S. retailers to make use of Amazon’s shipping capacity, because they won’t want to give Amazon access to too much information about their production and sales.

    The new service wouldn't be anything like Prime, with its two day delivery promise.

    “You’d be buying directly from a factory in China. The goods could be put in an ocean container and it would take four to five weeks for them to arrive,” he said. The packages would likely be pre-sorted in China and then delivered to U.S. Postal Service for final delivery to customers.

    The upside? “It will be almost free, it’s so cheap,” Peterson said.

WE DON'T HAVE ENOUGH TRACTORS FOR OUR DSR'S ALREADY BUT STILL THE TRUCKS KEEP BREAKING DOWN OUR MANAGEMENT SENDS IT TO FIX AND THIER FEEDBACK TO THE DSR'S ARE, THE COMPANY IS CUTTING BACK AND THEY DOESN'T WANT TO PAY$$ SO MR JACOBS WE ARE ASKING YOU OTHER TERMINALS ARE GETTING RENTALS WHEN THEY NEED THEM AND FIXING THEM WHEN THEY HAVE TO SO WE ASK SR WHAT'S THE PROBLEM.   66. Our junior FOS was let go last Friday (Jan. 29). They told him when he came to work at noon,then asked him to finish out his shift and work the outbound.We couldn't believe they left him there to close things up by himself (the SCM didn't even hang around). They also told us Monday that they are going to eliminate our longest linehaul run starting March 4. I have a real uneasy feeling about all this.

    XPO Logistics Inc. has closed seven freight terminals in the former Con-way Inc. trucking network, extending cost reductions at the business it acquired last fall.

    The shutdowns in what XPO said were remote locations follow the elimination of 190 jobs last week in what the company said were back-office areas of the former Con-way Freight less-than-truckload operation, which sells delivery services on trucks for multiple customers.

    “We’re continuing to migrate to a more efficient LTL organization, with better network efficiency and greater utilization of our capacity,” XPO said in a statement. “As part of our planned restructuring, we decided to close seven service centers in remote areas without exiting any markets.
