XBO to vote on April 22, 2015 6am thru 1pm
Buffalo DSR here...the union busters are all set to start their propaganda fest on April 13, 2015. It will be a brutal week for us, keep us in our prayers.
I wonder if Greg Lehmkuhl will make an appearance and make his fake pussy crocodile tears wile pleading for another chance. When the vote was postponed in December, Greg was scheduled to come and see us, but promptly canceled his appointment when he heard of the postponement. That goes to show exactly how much we really mean to him and the rest of the corporate leadership.
They only care when they have something to loose.
Due to several ULP charges filed by the Teamsters in mid December our original vote set for December 19, 2014 was postponed by the NLRB pending investigation. The investigation has been completed and a hearing date set.
The NLRB has found enough evidence (mainly the company's own testimony gathered during the investigation)that the NLRB has issued a Notice of Hearing with a re-scheduled date of May 11, 2015 (the original hearing was to be April 27, 2015.) Case Number: 03-CA-142781

THE CHARGES
(a) Greg Lehmkuhl, via video message played at all terminals, announced a nationwide wage increase in response to union organizing efforts.
(b) Greg Lehmkuhl, via video message played at all terminals, announced nationwide changes to the safety policies in response to union organizing efforts.
(c) Tim Staroba, wile at XBO interrogated its employees about their union sympathies.
(d) Brett Thompson, at XBO threatened employees with implied loss of the above mentioned wage increase if they selected the Teamsters as their bargaining representative.
(e) Brett Thompson, at XBO, provided employees with daily free food in response to the Union’s organizing effort.
(f) Steven Beyer, at XBO, threatened employees with loss of the above mentioned wage increase if they selected the Teamsters as their bargaining representative.
(g) Greg Lehmkuhl, at all terminals, implemented a wage increase on January 4, 2015 in response to union organizing efforts.
(h) About January 8, 2015, Respondent suspended, and about January 12, 2015, discharged its employee Leon Higbee
(i) Con-Way engaged in the conduct described above because Leon Higbee assisted the Union and engaged in concerted activities, and to discourage other employees from engaging in these activities.
(j) By the conduct described above Con-Way has been interfering with, restraining, and coercing employees in the exercise of the rights guaranteed in Section 7 of the Act in violation of Section 8(a)(1) of the National Labor Relations Act.
(k) By the conduct described above Con-Way has been discriminating in regard to the hire or tenure or terms or conditions of employment of its employees, thereby discouraging membership in a labor organization in violation of Section 8(a)(1) and (3) of the National Labor Relations Act.
(l) The ULP's of Con-Way described above affect commerce within the meaning of Section 2(6) and (7) of the National Labor Relations Act.

THE REMEDY
As part of the remedy for the ULP's alleged above, Teamsters seeks an Order requiring Con-Way, to provide a copy of all payroll records necessary to analyze the amount of back-pay due under the terms of such Order.

As part of the remedy for the ULP's alleged above, Teamsters seeks an order requiring that the Con-Way reimburse Leon for all work search & work-related expenses regardless of whether the Leon received interim earnings in excess of these expenses, or at all, during any given quarter, or during the overall back-pay period.
As part of the remedy for the ULP's alleged above, Teamsters seeks an Order requiring that at a meeting or meetings scheduled to ensure the widest possible attendance, Con-Way’s representative Brett Thompson read the notice to the employees on work time in the presence of a Board agent.
Alternatively, the Teamsters seeks an Order requiring that Con-Way promptly have a Board agent read the notice to employees during work time in the presence of Con-Way’s supervisors and agents identified above.
In view of the extensive nature of the unfair labor practices alleged above Teamsters seeks an Order requiring Respondent to:
(1) post in all its terminals affected by ULP's alleged above, any Notice to Employees that may be issue by the National Labor relations Board
AND
(2) electronically post the Notice to Employees for employees at all its terminals affected by the ULP's alleged above, if Respondent customarily uses electronic means such as an electronic bulletin board, e-mail, website, or intranet to communicate with those employees
AND
(3) send a copy of any Board Order and Notice to Employees to all its supervisors at its Terminal's affected by the ULP's alleged above.
Look at that my brothers and sisters, ALL TERMINALS AFFECTED, that means Con-way will be posting a Notice to Employees at ALL TERMINALS.
Greg Lehmkuhl's wage increase, and change in safety policy was global, meaning company wide, and as such when this notice is ordered to be displayed by the NLRB, it will be global also.
"Con-way will fight it, they will never let it happen" you might say, they will of course appeal it, and they will loose that appeal and the order will come, and they will have no choice because it will be an order by a federal judge. Lehmkuhl has pulled some rather bone headed moves, but do you believe for a minute he will jeopardize his freedom by ignoring a federal order. Will he really chance contempt charges and jail time for it, I don't think so, how can he spend the money he stole from us if he's in prison.

You do not need an "Economic strike" to be permanently replaced, Conway can permanently replace you at anytime for any or no reason.
Seniority can be ignored, you can be placed on a different bid or start time, the policy is, Conway WILL USE you when and where they need they need you.
You can more easily be discriminated against, and it will be harder to fight it. Remember Marlon?
You will not have a grievance procedure. Conway's open door police is a joke, and you are seldom listened to. Remember Marlon?

You do not have defined breaks and lunches, and may be disciplined for breaking when it not convenient for Conway.
You have NO REPRESENTATION, such as stewards. Union stewards are fellow employees who represent the union on the job site. They make sure the contract is not violated, help employees who have problems with management.

You have no guarantee of wages, health benefits, raises, job security, hours, start time ect. Conway can, will and ALREADY HAS implemented unilateral changes to their benefit, and our detriment. We have lost sick days, good medical, pension, we have taken pay cuts, and 401k match reductions, start times have been adjusted, bids lost and fellow employees have been unjustly terminated. Trevor Lock is a great example, we didn't much like him, but come on, here's your anniversary pin, have some cake, and then "your fired" ..get the FUDGE out.
You can be disciplined at any time and for no cause. How many times have you been given a letter of instruction (or know some one who has) weeks or months after the fact, at a time when you cannot defend your self simply because you cannot remember the incident? With a contract Conway needs JUST CAUSE, and must adhere to a strict time limit.
You may face expensive (i.e. lawyer fees) legal protections, which are also law. These protections are included in the contract because it is easier and faster to enforce the rights under the union contract as opposed to filing charges as an individual.
You will not have any control over your future with Conway, You will never have a peer to peer relationship with Conway. Your relationship will always be as a child to parent, unfortunately without love, just absolute dominance!
You can be terminated at any time, for any or no reason at all (NYS is an employ at will state and it is in the policy book we are all "at will employees"). For example a centralized call center, an unreported puncture in a trailer's wall, damaged freight on a skid, or management is just having a bad day!
Remember...on vote day YOU have the power to make a difference for yourself and for all us. No one will ever know how you voted, unless YOU tell them. It is YOUR RIGHT to have a union, stand up for your rights, be strong and make a difference. The alternative is to live in fear and submission!

Greg visited us today at XBO. He implied a few threats. He talked about bargaining power, he told us we were worth less than 1/2 of 1 percent to Conway's total annual profits, told us we had nothing to bargain with. Talked about us going on strike. Told us he could fly in replacement drivers from other terminals in 6 hours, told us it wouldn't take him much longer to hire permanent replacements. He implied these 3 threats in less than 2 min (1 min 43 sec to be exact).

That showed us exactly how much we was "concerned for us", if we really gave a shit about us he would have kept his appointment to see us then! And now when he shows up he threatens us with implied closure and replacement!
He talked about this blog site, accused the union of administering it. No fucking clue its administered by his own employees, no fuckin clue it not the union posting here it is his own employees. Accused the union of calling him Numbskull on it and took great exception to being called that! Well after what I heard today, after being ignored in December, and then threatened today I propose we no longer call him Numbskull. I propose we should start calling him Dumbass!

I want this for my terminal so bad. We don't get over time till after 50 hrs. This right to work state we live in. It's time to change that. !!!!
Back in the day when this company use to be a union it use to be one of the best companies to work for. We have tried it without a union all these years, all I hear is complaints about how Conway treats its workers, so what do we have to loose by getting the union back? DeleteWe here at ULX were told that they were going to shut us down close the terminal we voted yes last October for union representation and they still haven't shut us down we are still getting our hours and some so to all the terminals out there that want to join us go for it don't be afraid of this scumbags we are the union !!

ReplyDeleteWhat i would like to see is XBO take conway to court and sue them for harassment and threating to be replaced in 6 hours.The 28 who voted for the union should be filing for a .lawsuit and make sure the court makes conway post all over its locations why there being taken to court.Their was a posting here about conway having to post something about a lawsuit at our location nothing was posted.Why isnt that being looked into.Conway is breaking the law by not posting that legal notice.Seems like nobody has the guts to stand up for there rights.

DeleteI agree with you blogger, that is definitely a threat & it's harrasment. I can't go inside of the minds of our brothers at XBO but I would probably guess just having NUMBSKULL there for that one day was probably a very intense day. I know they probably approached that day feeling confident that they was surley going to be UNION that day.
DeleteA lawsuit definitely needs to be filed, and then it needs to be extended into a class action suit. Not to stress XBO out right now but guys once you get yourselves together the ones who voted YES FOR UNION you guys get together in private away from the job.
