T-Mobile has been breaking the law, as a matter of corporate policy, a National Labor Relations Board administrative law judge ruled on Wednesday. Judge Christine Dibble wasn't hearing complaints of abuses against individual workers—because T-Mobile has settled quite a few of those—but was looking at the company's employee handbook, its official policies for workers. Basically, the employee handbook issued a series of gag orders:
According to the ruling, T-Mobile US’s email policy and various confidentiality policies violate the law by restricting employees’ ability to disclose or discuss basic workplace issues, such as their wages. Similarly, Judge Dibble has ruled that the company’s policy restricting employees’ communications with the media is illegal, as it prohibits employees from speaking out on inquiries about wages or other conditions of employment. In all, Judge Dibble found that 11 of the 13 corporate policies or provisions at issue in the case are illegal.The judge ordered T-Mobile to remove the illegal passages from the rules and post notices letting workers know about the changes. T-Mobile is trying to downplay this as some kind of boring "technical issue in the law," but:
“This is not the case of a rogue manager here or there,” said Joseph A. McCartin, a labor historian at Georgetown University. “This is saying that the company’s handbook contained a number of prohibitions that clearly violate the workers’ rights.”Labor law is still law. Breaking labor law is still breaking the law. And that's what T-Mobile did. What's more, T-Mobile's German parent company is unionized, and that union has already been raising questions about the American company's dodgy labor practices, giving American workers a pressure point beyond the weak penalties the NLRB can impose. Larry Cohen, the president of the Communications Workers of America, said in a statement that "Deutsche Telekom, the principal owner of T-Mobile US, has claimed that its U.S. subsidiary follows the law. Now we have the official word: T-Mobile US is a lawbreaker. Bonn, the headquarters of DT, no longer can hide behind the false statements made by T-Mobile US executives. These behaviors would be almost unimaginable in Germany or any other democracy in the world." No kidding. What's Deutsche Telekom going to do about its law-breaking subsidiary?

Ladies and gentleman I come to you with only the truth. we need everyone in this industry to actually open up your minds and your eyes and say to yourselves are we too blind to see the injustice, the indignity, the unpredictable, disrespect, behavior, the favoritism, and the discrimination false behavior from all these major companies believe me it exist and starts with your fellow employees that you bond with and work with every day of your lives guess what they even betray you sometimes, and sometimes you call them your friend. When does it end with I'll tell you when with Union Representation. Company's only set the rules to there fulfillment and conditions of convenience of their policies, regulations of confinement that they could bend and break at any given time they want, that's why we are all at will employees in the state of Florida. None of these major companies want Union because in this case we will not be at will employees anymore. Let's say you have a major conflict with an employee in your company and you write the problem to human resources of the this conflict, the only response you will get back in the end is have you spoken to your manager about this, and it's a back and forth, a writing battle to get the final answer, so you can find justice in good faith but my friends when you bargain with the devil there is never good faith, but there will be no justice for they simply throw it under the rug like nothing ever happened, of what happened but in the end nothing will get done because they cover it up because these major companies cannot handle the truth they don't want to hear it they could care less about it, they make the rules they Break them, and that is final and there's nothing you can do about it unless it shows discrimination and you need to prove it, favoritism and you need to prove that too.
Also Supervisors you try to work with them help them out with the problems they face everyday although management is part of the problem you give them solutions but in the end they will do whatever the Fuck they want to do anyway. So this concludes my moral story to whoever wants to listen because in the end you will all do whatever the fuck you want to do because in the end we're only Human.

ReplyDelete(STOCKTON, Calif.) – A group of 50 drivers at FedEx Freight’s Stockton, Calif., terminal have voted to join Teamsters Local 439. The vote took place Thursday, March 12 and today, and the workers voted 33 to 12 to become Teamsters.
“The company spent huge amounts of money and time to try to get us to vote no, but we remained focused on changing how FedEx treats us so that we can have a say on the job,” said Mel Mendieta, a FedEx Freight driver.
“We know that the only way to win job security, an improved health plan and strong retirement security is to stand together as Teamsters,” said Jorge Lopez, a driver.
“I am proud of the workers here in Stockton for sticking together despite the company’s pressure,” said Ken Guertin, Local 439 Secretary-Treasurer. “We will work hard to negotiate a strong contract that gives these workers their rights and protections in writing.”
This victory follows three previous ones in 2014: On November 19, a group of 222 drivers at FedEx Freight in Charlotte, N.C., voted to join Teamsters Local 71; on Oct. 31, a group of 113 drivers at FedEx Freight in South Brunswick, N.J., joined Teamsters Local 701 in North Brunswick, N.J.; and on Oct. 14, a group of 47 drivers in Croydon, Pa., voted to join Teamsters Local 107 in Philadelphia. Other campaigns at FedEx Freight are under way.

(WASHINGTON) – Drivers with Ryder Integrated Logistics at three California locations have voted to join the Teamsters Union, gaining representation for 105 workers in one week.
The drivers in Orange, Riverside and Fontana, Calif., united to improve wages, health insurance, working conditions and treatment on the job.
There are 84 drivers in Riverside and nine drivers in Fontana who are now members of Teamsters Local 166 in Bloomington, Calif., and 12 drivers in Orange, Calif. who have joined Teamsters Local 952, also located in Orange.
“We wanted to make changes, to get respect, dignity and a union,” said Victor Medina, a 15-year driver in Orange. “We are good, professional drivers and things need to be better for us.”
The drivers united over changes by the company to the wage structure, which meant working more hours for less pay; excessive health insurance costs for individuals and families; and how they feel they are treated at work.
“It’s embarrassing what has been done to us. Instead of having a raise after six years working here, they dropped our rates. I like my job, but we deserve respect. That’s why we wanted to join the Teamsters,” said Alejandro Diaz, a driver from Riverside.
Junior Hernandez, a Ryder driver who works in Fontana, heard about the Teamsters through his brother, who is a member.
“It’s a great organization and the mechanics here are Teamsters. I want to be part of that team,” Hernandez said.
Teamsters Local 495 in West Covina, Calif., represents about 350 Ryder mechanics throughout Southern California and Las Vegas, and has represented them for 40 years.
